Capitalized terms in these Terms shall have the following meanings, unless otherwise indicated:

- User – a natural person, legal person, or organizational unit without legal personality, fully capable of legal acts, using the Website under the Terms.
- Every person visiting the Website is obliged to comply with the Terms. All activities undertaken on the Website must comply with applicable laws, good manners, and social coexistence principles.
- The Administrator provides Users with access to the content of the www.villapark.pl website, i.e., provides electronic services as defined in the Act of 18 July 2002 on the Provision of Electronic Services. The Provider under this act is the Administrator.
- To use the Website, the following are required: Internet connection, a web browser that allows viewing pages on a computer or other electronic device and supports JavaScript, also accepting Cookies and supporting SSL encrypted connections.
- All rights to the Website and its elements belong to the Administrator, and all materials or their elements, including texts, graphics, layout (so-called layout), trademarks, photos, audiovisual materials, applications, software, and other information and elements protected by law on the Website belong to the Administrator. Any unlawful use is prohibited and may result in civil or criminal liability. This especially includes the prohibition of copying, modifying, reproducing, or distributing these materials in any form except as permitted by law. The User or any other person using the Website may contact the Administrator to verify whether a statement submitted by them or on their behalf has been made.
- The Terms are made available to users free of charge via the Website, in a form that permits downloading, saving, and printing.
- The Administrator is not responsible for any actions or omissions of Users related to the use of the Website.
- The Administrator does not guarantee that the data provided by Users concerning their identity is true.
- The Website and all services provided through it are made available as is. Using the Website implies the User's declaration that they have familiarized themselves with how the Website operates and accept it in its current form. This does not exclude the Administrator's right to introduce new technical solutions aimed at improving the operation of the Website and services.
- The Administrator may present links, materials, presentations, and other content referring to third-party offers and services or may enable Users access via the Website to services provided by third parties. Such content and services are not part of the services provided by the Administrator, and the terms of use are defined by the respective third parties. The Administrator is not responsible for the conditions and effects of using such content by Users nor for any actions or omissions by third parties. The Administrator is also not responsible for the content of external websites linked from the Website.
- The Administrator is not liable for disruptions in the functioning of the Website or loss of User data caused by force majeure, third parties, or actions by the Administrator aimed at improving the Website's functionality.
- To the fullest extent permitted by mandatory law, the Administrator's liability for actual damage or lost profits is excluded unless such damage was caused intentionally or by gross negligence by the Administrator.
- In other cases, the Administrator's liability for actual damage caused to Users or lost profits is limited as follows:
- The Administrator is liable only in case of intentional fault or gross negligence;
- The Administrator’s total liability towards a User is limited to the amount of PLN 1,000.
- Users are fully responsible to the Administrator for damage resulting from or related to violating laws, the Terms, good customs, social coexistence principles, or third-party rights, especially for damages related to untruthfulness, inaccuracy, or incompleteness of any User's declarations.
- The Operator provides Users with the email address: marketing@mpmhotelespa.pl for contact, where Users can send queries, suggestions, comments, and information.
- The Administrator may send Users messages related to the Website content via email.
- Complaints regarding the Website should be sent to marketing@mpmhotelespa.pl or in writing to the Administrator’s address.
- Users may file a complaint if services are performed by the Administrator contrary to the Terms.
- A complaint should contain at least the User's email address and name.
- If the complaint data or information need to be supplemented, before processing the complaint, the Administrator may ask the complainant to provide the requested information.
- The Administrator examines complaints within 14 days of receipt in proper form; however, the Administrator may refuse to consider complaints submitted after 90 days from the cause becoming apparent.
- A response to the complaint (written or email) will be sent to the address or email provided in the complaint or the email assigned to the User's account.
- Provisions of this section do not affect the Users' rights (including consumers) arising from mandatory legal regulations.

- The Administrator processes your personal data for the purposes of:
- responding to your inquiries sent via the contact form on the website,
- sending newsletters to you,
- reservation of rooms and services offered by entities belonging to MPM Hotele SPA Sp. z o.o.
- Your data is processed based on Article 6(1) letters a), b), c), and f) of GDPR.
- For responding to inquiries, your data processed includes first name, last name, and email address.
- For sending newsletters, your personal data processed is your email address.
- For room and service reservations, personal data processed includes first name, last name, email address, phone number, and bank account number.
- Your personal data will be processed:
- for inquiries, until the answer is provided and then for a period of 1 year,
- for newsletters, until consent is withdrawn,
- for reservations, for 3 years from data registration.
- Your data may be processed for a longer period if required by mandatory law.
- Data is protected by technical and organizational measures to ensure the appropriate level of security according to applicable laws.
- The Administrator may collect data from third parties who may book stays for you at hotels belonging to the Administrator.
- The Administrator does not collect data from publicly available sources.
- Your data will be transferred to the service provider Profitroom Sp. z o.o. based in Poznań, ul. Roosevelta 9/3, 60-829 Poznań, KRS 0000303746; NIP: 525-24-23-458; REGON: 141374990 – for the purpose of enabling you to book hotel rooms.
- Your data may be transferred to third parties responsible for processing payments for rooms and/or services — those entities act as separate personal data controllers.
- You have the right to:
- obtain information about the data processing, including categories of processed data and possible recipients;
- request correction of inaccurate or completion of incomplete data;
- request deletion of data by objecting to its processing;
- request restriction of data processing under legal conditions;
- data portability by receiving data in a format that allows transfer to another third party;
- withdraw consent at any time without affecting the lawfulness of processing before withdrawal;
- file a complaint to the supervisory authority, President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw, if data is processed unlawfully.
- Your data will not be subject to automated decision-making, including profiling.
